AP Municipal Elections Halted: SEC Takes Key Decision Following Supreme Court Order

The Andhra Pradesh State Election Commission (SEC) has ordered an immediate suspension of the ongoing election process in 100 urban local bodies, including 13 municipal corporations, 87 municipalities and other urban local bodies, following directions from the Supreme Court of India.

The decision comes amid allegations by the YSR Congress Party (YSRCP) that several candidates were prevented from filing nominations due to alleged threats, obstructions and law-and-order problems during the municipal election process.

Supreme Court Directs Review of Nomination Complaints

As part of the election schedule for 100 urban local bodies in Andhra Pradesh, nominations were accepted from October 16 to October 18. The scrutiny of nominations was conducted on October 19.

However, the YSRCP approached the Supreme Court, alleging that some of its candidates were obstructed from submitting their nomination papers and were unable to contest the elections due to alleged intimidation and disturbances.

After hearing the petitions, the Supreme Court directed the State Election Commission to postpone the publication of the final list of candidates until October 25. It also instructed the commission to examine the complaints, supporting evidence and electronic records submitted by the candidates.

The court further stated that if the evidence establishes that candidates were prevented from filing nominations because of law-and-order issues, the SEC should consider extending the nomination deadline in the affected urban local bodies.

SEC to Issue Further Orders on October 22

The Supreme Court directed the State Election Commission to announce its decision on the nomination-related complaints by October 22.

If the commission decides to extend the nomination deadline in any affected area, it must amend the election notification to provide candidates with at least 48 additional hours from the time the decision is announced.

Following the court’s directions, the SEC has suspended the subsequent stages of the election process across the 100 urban local bodies with immediate effect.

The commission said it would review reports from district collectors, district election officers, police commissioners and superintendents of police before issuing further orders on October 22.

Will the Nomination Deadline Be Extended?

The next decision by the Andhra Pradesh State Election Commission is expected to determine the course of the municipal elections in the affected areas.

The key questions are whether the commission will find evidence of obstruction during the nomination process and whether candidates will be given an additional opportunity to file their nomination papers.

The SEC’s decision will clarify whether the nomination process will be reopened in specific urban local bodies or whether the election schedule will continue under revised directions.

The development has added uncertainty to the Andhra Pradesh municipal elections, with political parties and candidates awaiting the commission’s next announcement.
